An Erie man was flown to a local hospital after the ATV he was riding flipped over and fell on him. The accident occurred Sunday at the Slippery Rock Dunes Outdoor Park on Barron Road in Worth Township. The victim was riding with his friends when as he was going up a hill, the ATV rolled over and landed on top of him. The ATV weighs roughly 500 pounds. Firefighters had to use a utility truck to reach the man who was half a mile into the woods. He was then carried in a stokes basket to paramedics. He was transported by helicopter to UPMC Hamot for treatment of his injuries. First responders said the man was conscious at the time of the accident but was in a lot of pain.
Recovering compensation after an injury from a defective product
An investigation into the accident is likely to occur. They will look to see if there was any negligence that may have caused the accident. Also, they will look into the ATV itself to see if there was a possible defect in the ATV that caused the driver to crash. Some ATVs may be poorly designed and prone to rollovers. In these cases, a product liability claim or personal injury claim may be filed.
It is a manufacturer’s responsibility to make sure their products are safe for consumers. If someone is injured due to a defective product, a product liability claim may exist. A claim may be pursued to pay for damages caused by the defective product such as medical bills, missed time from work and pain and suffering.
