How to Appeal Your Social Security Disability (SSD) Denial

A Social Security Disability (SSD) denial is not a final answer. In fact, you have many opportunities to challenge your denial and get the decision reversed through the various stages of the process. The first is to file a request for reconsideration.

Request for Reconsideration

A request for reconsideration is a formal letter stating that you disagree with the denial and would like the SSA to take a second look.

This step must be taken before you can move to subsequent stages in the appeals process, including an Administrative Law Judge (ALJ) hearing. You must file your reconsideration request within 60 days of receiving your initial denial.

ALJ Hearing

If the SSA does not approve your reconsideration request, you may then ask for a hearing in front of an Administrative Law Judge (ALJ). The ALJ hearing stage offers the best approval chances of any step of the appeals process. But if it does not pan out for you, you may take your case to a body known as the Appeals Council. This group will review your appeal and decide whether to approve it, uphold the denial, or ask the ALJ to take another look.

Federal Court

Social Security Disability Requirements

You must meet strict qualifying criteria to receive Social Security Disability. These requirements include both medical and non-medical qualifications. The medical criteria are the same for both Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI). The non-medical requirements differ from one program to the other.

Medical Requirements

The medical requirements are the same for SSDI and SSI. Social Security requires full disability to receive benefits. This means that if you are able to work, you may not get approved for disability. Most disability recipients cannot work at all, and those who can are typically employed in very limited part-time jobs or in sporadic or seasonal positions.

Non-Medical Requirements

SSDI and SSI have very different non-medical qualifying criteria. SSDI is an insurance program funded by payroll taxes, so if you do not have a substantial work history and thus have not paid much in these taxes, you may get denied on a non-medical basis if you apply for SSDI.

In contrast, SSI is a benefits program for those in need, so having a long employment history is not required. However, the program has strict income and asset caps. You must prove you have a true financial need in order to qualify.
