Getting Approved Based on Your Diagnosis and Symptoms

The Social Security Administration publishes a book of qualifying impairments called the Blue Book. There is no entry for avascular necrosis in the Blue Book, but you may still qualify if you suffered damage to a major joint because of the condition. Most people who meet an impairment listing for avascular necrosis qualify under Section 1.02 – Major Dysfunction of a Joint.

Under this impairment listing, you may be able to get disability if you can prove:

• This joint is weight-bearing and limits mobility; or
• The condition affects an upper extremity and limits your abilities.

In addition, you will need to show:

• The affected join suffers a “major ”
• You have chronic pain and stiffness in the joint.
• Your doctor has documented a limited range of motion in the joint.

If you underwent a hip transplant and still cannot walk because of avascular necrosis, you may qualify under Section 1.03 instead.

You Can Get Disability Without Meeting an Impairment Listing

If you cannot work because of your symptoms but do not meet the strict criteria under any impairment listing, you may be able to get approved for benefits based on your residual functional capacity (RFC). Your RFC considers:

• Your remaining abilities despite your disability.
• Your age.
• Your training, education, and experience.
• The types of work you can do.
• How long you can work.
• How often you can work.
• If you can work with accommodations.

There are three ways the Office of Disability Determination Services may evaluate your RFC:

• A doctor from the agency can assess your RFC based on your application materials and medical records.
• Your doctor can assess your RFC based on their knowledge of your case.
• You can attend a consultative exam scheduled and paid for by the Social Security Administration.

If any of these methods conclude that you cannot work any job you might get, you will likely be approved for disability. Alternatively, you may be approved if you can work but require accommodations.

You Must Also Meet All Technical Qualifications for the Disability Program

Each disability program has its own technical requirements you must meet before you get approved for benefits. The local Social Security field office will check to ensure you meet these qualifications before they forward your claim to the Office of Disability Determination Services. If you do not, you will receive a technical denial.

Social Security Disability Insurance

SSDI bridges the gap between working and qualifying for Social Security retirement benefits. It is only available if the person paid into Social Security taxes through their job. Paying these taxes earns you work credits, and you must have a certain number of work credits to get SSDI.

Supplemental Security Income

SSI, on the other hand, does not have a work credit requirement. It is a need-based program and considers only your household income and assets when you apply. However, these limits are very low, and you could receive a technical violation if you make too much money.
