Getting Disability Based on a Guillain Barre Diagnosis

The Social Security Administration publishes a book of qualifying impairments known as the Blue Book. Guillain Barre syndrome is not in this book, as Guillain Barre sufferers who seek treatment usually recover fully in less than a year. However, if your symptoms or related complication will likely last a year or more, you may qualify.

The Social Security Administration will evaluate you based on your symptoms to determine if you meet one of their impairment listings. Some of the most common include:

• Section 1.02 – Major Dysfunction of a Joint
• Section 3.02 – Chronic Respiratory Disorders
• Section 14.0 – Immune System Disorders

Each of these impairment listings has its own criteria you must meet to get approved for benefits. To prove you qualify, the disability examiner handling your case will want to see medical evidence. This could include blood tests, other clinical tests, medical imaging, notes about your treatment and outcomes, and other information from your medical records.

When you apply for disability, you will need to provide contact information for your doctor(s) to ensure the disability examiner has access to all your records. Getting Disability Without Meeting an Impairment Listing

You may be able to get approved for disability benefits without meeting the qualifications under an impairment listing. This is possible through your residual functional capacity (RFC). This evaluation determines the type of work you can do despite your impairment, how long you can work, and how often you can work.

There are three ways the Office of Disability Determination Services can evaluate your RFC:

• The disability examiner can assign an RFC based on your medical records and evidence
• Your doctor can submit an evaluation form to support your application
• You can attend a consultative exam scheduled by the Social Security Administration and allow a third-party doctor to complete your evaluation

No matter which method Office of Disability Determination Services uses to evaluate your RFC, you will likely be eligible for disability benefits if they find you cannot work your last job, cannot work any other job you qualify for, or can work but require accommodations.

Meeting the Technical Criteria for Disability Benefits

Proving you suffer from a qualifying impairment is not the only criteria for getting disability benefits. You also need to meet the technical qualifications for the program. If you do not meet one or more of the technical qualifications, the Social Security Administration could deny your claim before they ever even consider your medical condition.

Some of the most common reasons for a technical denial include:

• Not completing all sections of the application
• Skipping forms or refusing to submit some information
• Submitting incorrect information
• Not having the required number of work credits for SSDI
• Having too much income or too many assets for SSI
