Police believe the driver of the vehicle was speeding when he lost control of his vehicle and went off of the roadway. The passenger side of the vehicle crashed into a tree. The car then spun clockwise before it came to a stop.
Neither the driver nor the passenger were wearing seatbelts at the time of the accident. The passenger was pronounced dead at the scene of the accident due to blunt force trauma. The driver, a 21-year-old male, was transported to UPMC Hamot with serious injuries.
Police called an accident reconstruction crew to the park to investigate. The park was closed for several hours while police and emergency crews cleaned up the scene.
Since the accident involved only one vehicle, most likely the driver will be found to be at fault. Also, when a driver hits something, like a tree, typically they were negligent in the operation of their vehicle. However, there are always exceptions.
In this particular case, the passenger’s family members may file a wrongful death claim against the at fault driver. When a passenger is injured in an accident, they almost always have a case. This is because the passenger sustained injuries as a result of a negligent driver.
